General Terms and Conditions (GTC)

1. Scope and provider

These General Terms and Conditions (GTC) apply to all orders placed through the online shop thegolferlab.com. The provider and contracting party is:

By placing an order, the customer agrees to these GTC. Deviating conditions apply only if expressly acknowledged in writing.

2. Conclusion of the contract

The presentation of products in the shop is not a binding offer but a non-binding invitation to place an order. Before you submit your order bindingly, you are shown an overview of the products, prices and the total amount. By completing the order process you make a binding offer to purchase and confirm that you have read and accepted these GTC.

The contract is concluded as soon as the provider confirms the order by email or ships the goods. An automatic acknowledgement of receipt does not yet constitute acceptance.

3. Contract language and legal capacity

The contract is concluded in the language of the shop version used for the order, that is in German or in English. By placing an order the customer confirms that they are of legal age and have full legal capacity.

4. Prices

All prices are stated in the currency shown in the shop: Swiss francs (CHF) for deliveries to Switzerland, euros (EUR) for deliveries to Germany and Austria. All prices include the applicable statutory VAT. The price displayed at the time of the order is decisive. Where stated, comparison or crossed-out prices refer to the regular selling price previously charged by the provider.

5. Payment terms

The payment methods shown during the order process are available: Visa, Mastercard, American Express, UnionPay, PayPal, Klarna, TWINT and Apple Pay. The availability of individual payment methods may depend on country, device and browser. Payments are processed by Shopify's certified payment service providers. The purchase price is due upon conclusion of the contract.

6. Delivery

We deliver to Switzerland, Germany and Austria. Shipping is free and trackable. The estimated total delivery time is 2-10 working daysfor Germany and Austria and 2-5 working daysfor Switzerland. Details are set out in our shipping policy. Unless expressly designated as binding, delivery times are non-binding guide values.

7. Retention of title

The delivered goods remain the property of YMJ Productions GmbH until payment has been made in full.

8. Right of return and withdrawal

Voluntary right of return: Irrespective of statutory rights, the provider grants all customers a voluntary right of return of 30 days from receipt of the goods. Within this period the goods may be returned without giving reasons, provided they are unused, complete and in their original packaging. Returns are free of charge: every order includes a free return label . On request, an exchange (for example for a different variant) is possible instead of a refund. After we have received and checked the return, we refund the purchase price within 7 days to the original means of payment. A message to support@thegolferlab.com is sufficient.

Customers resident in Switzerland have no statutory right of withdrawal; the voluntary 30-day right of return described above applies instead.

Withdrawal instructions for consumers in the EU (Germany, Austria)

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (YMJ Productions GmbH, Freie Strasse 45, 4001 Basel, Switzerland, email: support@thegolferlab.com, phone: +41 79 769 11 22) of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You may use the model withdrawal form below, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal. If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal; as a rule the refund is made within 7 days of receipt of the return. For this reimbursement we use the same means of payment as you used for the original transaction, unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier.

You shall send back the goods or hand them over to YMJ Productions GmbH, Freie Strasse 45, 4001 Basel, Switzerland without undue delay and in any event not later than fourteen days from the day on which you notify us of the withdrawal. The deadline is met if you send back the goods before the period of fourteen days has expired.

We bear the direct cost of returning the goods: every order includes a free return label.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9. Warranty and guarantee

The statutory warranty provisions apply. In addition, the provider grants a 1-year warranty on the rangefinder from the date of purchase against defects in material and workmanship. Excluded are damage caused by improper handling, normal wear and tear and interference by third parties. In a warranty case the product is repaired or replaced at the provider's discretion. 10. Liability

The provider is liable for damage caused by gross negligence or intent and for the breach of essential contractual obligations to the extent required by law. Any further liability, in particular for slight negligence and for indirect and consequential damage, is excluded to the extent permitted by law.

Excluded from these limitations of liability is liability for damage resulting from injury to life, body or health and liability under mandatory product liability law; these remain unaffected.

11. Use of the website and customer obligations

The customer undertakes to provide truthful and complete information when ordering and not to use the website improperly or unlawfully. The access data of any customer account must be treated confidentially and protected against access by third parties.

12. Intellectual property

All content of the shop (texts, images, graphics, logos and the TheGolferLab trademark) is protected by copyright and trademark law and is owned by YMJ Productions GmbH or its licensors. Any use, reproduction or distribution without prior written consent is prohibited.

13. Data protection

The provider processes personal data in accordance with the Swiss Data Protection Act (DSG) and, where applicable, the EU General Data Protection Regulation (GDPR). Details can be found in our privacy policy.

14. Changes to the GTC

The provider may amend these GTC at any time. The version valid at the time of the order applies. Subsequent changes do not apply to contracts already concluded.

15. Applicable law and place of jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Basel, Switzerland, to the extent permitted by law. Mandatory places of jurisdiction and protective provisions in favour of consumers, in particular in the EU, are reserved.

16. Dispute resolution

The European Commission's online dispute resolution platform (ODR platform) was discontinued on 20 July 2025. The provider is not obliged and generally not willing to take part in dispute resolution proceedings before a consumer arbitration board. Please send your concerns directly to support@thegolferlab.com. We reply within 24-48 hours.

17. Severability clause

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
